Does a Short Sale Ruin Your Credit in Las Vegas?

by | Oct 22, 2026 | Bankruptcy, Short Sale

A short sale hurts your credit, but it does not have to ruin it. Your mortgage shows up as settled for less than the full balance, and that mark stays on your credit report for up to seven years. A short sale with no missed payments and no reported deficiency generally does less damage than a foreclosure.

A short sale hurts your credit score and stays on your credit report for up to seven years, yet it typically does less damage than a foreclosure, and Fannie Mae’s wait for a new mortgage is four years after a short sale instead of seven years after a foreclosure.

You are behind on the house, the lender keeps calling, and someone mentioned a short sale. When you are in financial distress, you want to know what happens to your credit. Over the last 90 days, our website showed up in Google for 65 different searches about short sales and credit, so plenty of people share your question. This guide shows Las Vegas homeowners like you what a short sale does to your credit score, how long the mark lasts and what Nevada law adds. Read it before you sign anything with your lender.

What happens to your credit when you do a short sale?

A short sale is a sale of your home for less than you owe on your mortgage, and the Consumer Financial Protection Bureau calls it a form of loss mitigation. It is an alternative to foreclosure, but you still leave your home because it is a sale. Your mortgage lender has to approve the sale price before closing. If you are carrying an underwater mortgage, ask your lender whether it reviews short sale requests before you list.

Your credit report will not say “short sale.” According to Experian’s short sale guide, the account carries codes that read “settled” and “account legally paid in full for less than the full balance.” Search your file for those words, not for the words short sale. Look for it on your mortgage account, not in a separate section. Once you know the label, you know what to look for on every report you pull.

Why the score drops at all

Your score falls because you settled the mortgage for less than you owe instead of repaying it as agreed. The size of the drop depends on the rest of your file, the scoring model and whether your lender reports a deficiency balance. Experian says a reported deficiency balance might make your short sale hit your scores like a foreclosure would. Ask your lender in writing how it plans to report the account before you accept its approval letter.

Does a short sale ruin your credit as badly as a foreclosure?

No, in most files it does less harm. Experian’s comparison of short sale vs. foreclosure says a short sale typically does less damage to your credit. Foreclosures are always preceded by late payments, while a short sale is possible before you ever fall behind. That gap in your payment history is one reason the two marks score differently.

What you face Short sale Foreclosure
How it reads on your report Settled for less than full balance Foreclosure
Late payments before it Not required Always
Time on your report Up to seven years Up to seven years
Fannie Mae wait for a new mortgage 4 years (2 with extenuating circumstances) 7 years (3 with extenuating circumstances, plus added limits)

Your payment history before the sale

Experian says the overall impact on your scores might be smaller if you never missed a payment before selling the home. Late payments typically hurt your scores, so each one you add while you wait on the sale works against you. If you are still current, protect that record while you work through the short sale process. Talk to your lender about the timeline before you change how you pay.

Your starting score matters too. People with higher scores tend to see larger drops from new negative information, so a homeowner with excellent credit often sees the largest drop. Either way, on-time payments on every account you keep open add positive information to your report. Start that habit the month your sale closes.

How long does a short sale stay on your credit report?

Federal law sets a seven-year limit on most credit report entries. The Fair Credit Reporting Act, at 15 U.S.C. 1681c, keeps most adverse items off your report once they are more than seven years old. Your short sale follows the same seven-year rule. What changes is the date the clock starts. Here is how Experian explains it for your situation:

  • If you missed payments first, your seven years start on the date of the first delinquency that led to the short sale.
  • If you never missed a payment, your mortgage account falls off your report seven years after the lender reported it as settled.
  • Either way, Experian says a good score might need several years to fully recover, and an excellent score might need the full seven.

Your bankruptcy questions follow a different clock, so read our guide on how long bankruptcy stays on your credit report if you are weighing both. Mark the starting date of your short sale in your own records today. You will want that date when you apply for credit again. It also helps you spot a report that keeps the entry past its seven years.

When can you buy a home again after a short sale?

Your next mortgage depends on the loan program, and Fannie Mae publishes its rules for anyone to read. Its Selling Guide on derogatory credit events requires a four-year waiting period from the completion date of a preforeclosure sale, which is Fannie Mae’s name for a short sale. A foreclosure carries a seven-year wait under the same guide. Put that three-year difference on paper when you compare your options.

Extenuating circumstances shorten your wait

Fannie Mae permits a two-year wait if you document extenuating circumstances. Its definition is strict: nonrecurring events beyond your control that cause a sudden, significant and prolonged drop in income or a catastrophic jump in your financial obligations. Keep proof of the event that caused your hardship. Save every letter, bill and pay stub that shows your financial hardship now, while it is easy to find.

The waiting period is only one of three conditions Fannie Mae sets. Fannie Mae also expects you to rebuild traditional credit, and a thin file does not count. Keep a credit card or car loan open and paid on time after your sale. Ask any future lender which guide it follows for your loan before you apply.

What does Nevada law say about a deficiency after a short sale in Las Vegas?

The deficiency is the gap between your sale price and what you still owe. The CFPB tells you to ask your lender to waive the deficiency before you go through with a short sale, and to get that waiver in writing and keep it. A waiver means your lender gave up the right to collect that amount. It also matters on your credit report, where a reported deficiency balance might make a short sale score like a foreclosure.

Nevada adds a protection that some Las Vegas and Henderson homeowners qualify for. NRS Chapter 40 defines a “sale in lieu of a foreclosure sale” in NRS 40.429. It is a sale you agree on with your lender when the price falls short of the full balance and the costs of the sale, and a short sale your lender approves fits that description. Under NRS 40.4638, a junior lender that is a financial institution cannot sue you on that junior loan after the sale if every condition fits: your home is a single-family dwelling you still owned at the time of the sale, you used that junior loan to buy the home, you lived there continuously as your main home after taking the loan, and you never refinanced that junior loan. When that bar does not apply, NRS 40.4639 gives the junior lender only 6 months after the sale to file.

Second mortgages and home equity lines

Every lender with a claim on your house has to approve the short sale. Experian notes that second mortgage holders often stand to collect nothing and sometimes withhold permission or demand a cash payment before releasing their claim. If you have a home equity line, bring its statements to your first meeting. Without that second lender’s approval, your sale does not close.

Taxes on the forgiven balance

Debt forgiveness has tax consequences, and the IRS says your creditor may send you a Form 1099-C after a debt is canceled. IRS Topic 431 lists an exclusion for qualified principal residence indebtedness discharged before January 1, 2026, or discharged under an arrangement entered into and evidenced in writing before that date. If your sale closes in 2026, ask a tax professional whether any exclusion still applies to you. Take your 1099-C to a tax professional before you file your return.

How Vohwinkel Law helps you weigh a short sale against your other options

A short sale is one option, not your only one. Vohwinkel Law handles short sales for Las Vegas homeowners, foreclosure defense and mediation, loan modification requests, and Chapter 7 and Chapter 13 bankruptcy. You get one office that compares your debt relief options against your goals. My advice: compare a short sale with a loan modification and with Chapter 13 before you list the house.

Bankruptcy changes the deficiency question. Under the U.S. Courts’ Chapter 7 basics, a discharge releases individual debtors from personal liability for most debts. If you want to keep the house, our page on how Chapter 13 stops a foreclosure shows you that route. My second piece of advice: never sign a short sale approval letter until you have read how it treats the deficiency.

Will a short sale show up as a foreclosure on my credit report?

No, your report typically shows the mortgage as settled for less than the full balance, not as a foreclosure. Fannie Mae’s guide names “Settled for less than full balance” as the typical remark for a short sale. Fannie Mae still lists it as a significant derogatory credit event. Read your report so you know exactly which remark your lender used.

How many points does a short sale drop your credit score?

No single number applies to everyone. Your drop depends on your full file, the scoring model and whether a deficiency balance is reported. Higher scores tend to fall further than lower ones. Ignore any website that promises you an exact figure before seeing your report.

What if my short sale is reported wrong?

You have the right to dispute errors on your credit report. The CFPB’s dispute instructions tell you to contact both the credit reporting company and the company that provided the information. Send your written deficiency waiver with the dispute if the lender reports a balance it agreed to forgive. Keep copies of everything you mail.

Do I have to pay the difference after a short sale in Nevada?

Your answer turns on your waiver and your loan. A written deficiency waiver means your first lender gave up the right to collect that balance. A junior lender that is a financial institution cannot sue you on that loan under NRS 40.4638 when you, your home and that junior loan meet every condition in the statute. Have your loan history ready so you know which rule fits your house.

Should I file bankruptcy instead of doing a short sale?

Compare the two against your goals and your timeline. Fannie Mae’s waiting period after a Chapter 7 discharge is four years, and after a Chapter 13 discharge it is two years. A bankruptcy discharge also releases your personal liability for most debts. Your choice depends on whether you want to keep the house, so get advice on both options before you decide.

Does a short sale hurt my credit if I never missed a payment?

Yes, though the hit might be smaller. Your account still reports as settled, and that remark lowers your score. Experian says the impact might be smaller without late payments, and your seven years start on the date the account was reported settled. Stay current through closing if your budget allows it.
